Will building insurance cover lost rent after a fire?

Lost rent may be covered if the policy includes rental value or relevant business income coverage and a covered loss interrupts occupancy. Review the coverage terms, waiting periods, limits and restoration period, and document leases, rent records and the reason each unit cannot be used.

What to check in the policy

  • Whether the policy has rental value, fair rental value or business income coverage. Not every building policy does.
  • Any waiting period before coverage starts
  • Limits, including time and dollar limits
  • The period of restoration: how the policy defines the time it covers
  • Whether coverage applies only to units that cannot be occupied or also to partly usable ones
  • Exclusions and conditions for your type of property

Records to gather

  • Current leases for every unit
  • Rent rolls and bank deposits for recent months
  • Tax returns or financial records showing rental income
  • Notices to tenants and any move-out or termination letters
  • Photos and reports showing why each unit cannot be used
  • The repair schedule and contractor timeline
  • Any rent already refunded or waived

Keep the claim moving

The longer repairs take, the more the rental loss grows. A clear repair schedule and prompt documents help the insurer calculate it. Tell the insurer early which units are affected.

Not the same as living expenses

A homeowner’s additional living expenses cover extra costs for an owner who cannot live at home. Lost rent covers income the property would have earned. A landlord may have one, the other, both or neither.

Policy and state differences

Terms vary widely by policy and by state. A tenant’s right to reduced or suspended rent is a separate question that depends on the lease and state law. Check your policy and your state regulator. See our fire damage page.

FAQ

What records prove lost rent?
Leases, rent rolls, bank deposits, tax records, and proof that each unit could not be occupied because of the fire.

Is lost rent the same as a homeowner’s living expenses?
No. Living expenses cover the owner’s extra costs while they cannot live at home. Lost rent covers income the building would have earned.
